To all interested parties:
This web site formally contained false and offensive materials personally attacking me and my business interests. It was done by an individual who was attempting to coerce money from me. President Reagan once said, “I don't negotiate with terrorists”, and neither do I.
The entire malaise that occurred between the individual that created this “gripe” site occurred over him leasing and defaulting under a 1,200 square foot lease in one of my shopping centers. I offered to tear up his lease and relieve him of approximately $150,000 in rent obligations. Unwilling to take personal responsibility for the failure, he alleged that I misrepresented certain facts verbally prior to him entering into the lease — essentially luring him into signing the lease. The truth was to the contrary. Ultimately, the Superior Court of Yolo County agreed with me and threw out his case without a trial because the facts and evidence did not support his claims. During this time, I re-leased his space to another tenant and mitigated approximately $90,000 of his obligations.
Nonetheless, he still proceeded to drag me through a four day jury trial in Yolo County alleging that I failed to mitigate his losses to a greater degree, despite making no real effort himself. I prevailed in that matter as well.
This tenant made it his mission in life over a period of six years to discredit me through these lawsuits and this web site by circulating it amongst my peers and competition. This was done to maliciously wreak havoc on my family and my business. As some of you may recall from visiting the web site, he had posted photographs of my house, aerials and location maps, which tacitly endangered my three children, my wife and myself. He also sent my attorney what in my opinion was a thinly veiled threat by informing him that he had disclosed all of his assets except for a recently purchased handgun. He also posted the address of my attorney's house as a form of intimidation against him as well.
As if this was not enough, he then proceeded to appeal the original case to the Third District Court of Appeals of California. After two years, the three judge panel upheld the lower court's ruling. Further, they elected to publish the ruling as law and set new precedent. Now other property owners who find themselves attacked in a similar manner will have my case to rely upon in their defense. Still not satisfied, the tenant then appealed the decision to the California Supreme Court. Within approximately 48 hours of his application, the Supreme Court rejected his request to hear the matter.
Shortly after the judgment was awarded, the tenant wrongfully transferred his house he owned prior to his marriage to his current wife in an attempt to avoid collection. After another two years, just two weeks before trial to disallow the transfer, he agreed to pay me under a stipulated judgment the money owed now totaling approximately $225,000 on rigorous payment schedule On December 23, 2009, I have received full and complete payment of the outstanding judgment including my attorney's fees.
